Terms and Conditions – Aerial Space Vienna

1. Scope and contracting party

1.1 Your contracting party is the association Aerial Space Vienna (formerly Aerial Silk Vienna), represented by its Chair, Sophie Pfaffstaller, Domgasse 8, 1010 Vienna, Austria, Central Register of Associations (ZVR) no. 933975971, email: office@aerialspacevienna.at (hereinafter: ASV).

1.2 These General Terms and Conditions (T&Cs) apply to all services provided by ASV, in particular classes, drop-in classes, open trainings, workshops, kids classes, training programmes, retreats and other events, as well as to the purchase of class passes, memberships and vouchers.

1.3 The terms of use of Eversports also apply to the use of the Eversports booking platform. Any terms of participants that deviate from these T&Cs only apply if ASV has expressly agreed to them in writing.

2. Booking, conclusion of contract and prices

2.1 Bookings are made exclusively via Eversports (website widget or app). The contract is concluded when ASV or Eversports confirms the booking.

2.2 The prices shown in Eversports at the time of booking apply. Payment is made via Eversports when booking.

2.3 All classes, workshops and events have a limited number of participants. There is no entitlement to a particular spot, time or instructor. If an offer requires certain previous experience or a certain level, this is stated when booking and must be met by participants.

3. Drop-in classes, passes, membership and vouchers

3.1 Drop-in classes are valid for the session booked.

3.2 Class passes (e.g. 6-, 10- and 12-session passes for classes and workshops, as well as open training passes) are valid for 1 year from the date of purchase. Unused sessions expire at the end of the validity period. In the event of a longer absence due to illness, injury or pregnancy, ASV will extend the validity on request and upon proof by the duration of the absence. Passes are personal and non-transferable. Certain passes are reserved for members (see section 3.3).

3.3 The membership is paid as a one-off amount for the respective calendar year and ends automatically at the end of the calendar year. There is no automatic renewal. If the membership is purchased during the year, there is no pro-rata reduction or refund. The membership offers in particular reduced prices for certain classes and passes, access to passes available to members only, a free open training pass, reduced rig rental, member events and access to the WhatsApp community. The current benefits and prices are described on our website and in Eversports.

3.4 Vouchers can be redeemed for all ASV services unless stated otherwise on the voucher. Vouchers cannot be exchanged for cash. Vouchers are valid for 1 year from the date of sale. We are happy to extend expired vouchers as a gesture of goodwill on request by email to office@aerialspacevienna.at.

4. Cancellation by participants

4.1 The cancellation deadline for each offer is stated when booking in Eversports and is binding. As a rule:

  • Classes and workshops: up to 7 days before the start

  • Open trainings: up to 24 hours before the start

  • Offers with guest teachers, retreats and training programmes: longer deadlines due to travel and organisational costs; the exact deadline is stated when booking

4.2 You can cancel free of charge until the cancellation deadline. The booked ticket or product then remains in your Eversports account and can be redeemed again by you within its validity period. For class passes, the session is credited back to the pass. There is no cash refund.

4.3 After the cancellation deadline or in the event of a no-show, no refund is possible; a session booked with a pass counts as used. Partial attendance does not entitle you to a price reduction unless this was agreed when booking.

4.4 You can name a substitute participant free of charge up to 48 hours before the start, provided they meet the requirements for the offer. Please let us know by email to office@aerialspacevienna.at.

4.5 Missed sessions: Missed sessions of courses, workshops and classes cannot be made up and are not refunded. If you miss several sessions of a course due to illness or injury, you can send us a medical certificate by email to office@aerialspacevienna.at. We will then check on a case-by-case basis whether an individual solution is possible. Any further offers for missed sessions are granted by ASV voluntarily; they are described on our website and do not establish any legal entitlement.

5. Right of withdrawal for online purchases (FAGG)

5.1 For online bookings of offers on a specific date (e.g. classes, drop-in classes, open trainings, workshops, retreats and training programmes), there is no right of withdrawal under the Austrian Distance and Off-Premises Contracts Act (§ 18(1)(10) FAGG). The cancellation rules in section 4 apply.

5.2 When purchasing class passes, memberships and vouchers online, consumers may withdraw from the contract within 14 days of its conclusion without giving any reason. A clear statement is sufficient for withdrawal, e.g. by email to office@aerialspacevienna.at or by post to Aerial Space Vienna, Domgasse 8, 1010 Vienna, Austria. You may use the model withdrawal form for this purpose, but this is not mandatory. To meet the deadline, it is sufficient to send the statement before the deadline expires.

5.3 Following a timely withdrawal, we will refund all payments without undue delay and no later than 14 days, using the same means of payment that you used.

5.4 If you have expressly requested that we begin providing the service before the withdrawal period expires (e.g. by redeeming a session from a pass), you must pay us a proportionate amount for the services provided up to that point in the event of withdrawal (§ 16 FAGG).

6. Changes and cancellations by ASV

6.1 ASV may reschedule, relocate or cancel offers for good cause (e.g. insufficient number of participants, instructor illness, force majeure). We will inform you as early as possible.

6.2 If ASV cancels or reschedules an offer and you cannot attend the new date, you will receive, at your choice, a replacement date, a credit or a refund of the amount paid, or the session will be credited back to your pass.

6.3 A change to another qualified instructor does not entitle you to cancel or to a price reduction, unless the offer was expressly advertised with a specific person (e.g. workshops with guest teachers).

7. Use of the studios, conduct and safety

7.1 A booking entitles you to use the ASV studios at the booked times. The changing rooms are available to you 15 minutes before the start and 15 minutes after the end of each session. Open trainings are only available from the age of 18.

7.2 Please behave in a way that does not disrupt sessions, treats the equipment with care and does not affect others. Instructions from ASV instructors and staff must be followed, especially for safety reasons.

7.3 For your safety:

  • Jewellery (e.g. rings, watches, earrings, necklaces) must be removed before training.

  • Training only takes place with a crash mat.

  • Exercises are only performed as instructed and within your own ability.

7.4 In the event of serious violations, such as violence, threats, insults, harassment, theft or repeated disregard of safety instructions, ASV may exclude the person concerned from further participation, even after a first violation. In this case, amounts already paid will not be refunded.

8. Health

8.1 By booking, you confirm that you are in good health, able to meet the physical demands of the booked offer, and that there are no medical reasons against training. If in doubt, please check with a doctor beforehand.

8.2 Please inform your instructor before the session of any injuries, pre-existing conditions or other health limitations relevant to training. How we handle this information is set out in our privacy policy.

8.3 In the event of pregnancy, medical clearance must be obtained before participating.

8.4 Participation under the influence of alcohol, drugs or medication that impairs reaction or coordination is not permitted. If you have a contagious illness, please do not attend training.

9. Kids classes

9.1 Kids classes are for children aged 6 to 14. Bookings are made by a parent or legal guardian, who is also ASV’s contracting party.

9.2 ASV’s duty of supervision only applies during the booked class time. Before and after, it lies with the parents or legal guardians. Please bring and collect your child on time.

9.3 Children who are to go home alone may only leave the class on their own if ASV has received a prior written declaration from their parents or legal guardians. Without this declaration, the child will only be handed over to a parent or legal guardian or to a person they have named in writing.

9.4 Parents or legal guardians inform the instructor of any health limitations of the child (section 8) before the class begins.

10. Liability

10.1 Aerial arts is a sport with a certain risk of injury. Participation takes place within this risk typical of the sport. ASV is not liable for injuries resulting from disregarding instructions or from exercises performed on your own initiative.

10.2 ASV is fully liable for injury to life, body and health caused by the fault of ASV, its instructors or staff. For other damage, ASV is only liable in cases of intent or gross negligence.

10.3 There are no lockable lockers in the studios. Please take valuables with you into the training room. ASV is only liable for clothing, valuables or money brought along in cases of intent or gross negligence.

11. Data protection, photos and final provisions

11.1 How we handle your personal data, including photos and videos and health information, is set out in our privacy policy at www.aerialspacevienna.at.

11.2 Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, mandatory consumer protection provisions of the country of their habitual residence remain unaffected.

11.3 For claims against consumers, the court in whose district the consumer is domiciled, habitually resident or employed has jurisdiction (§ 14 KSchG). For businesses, the court with subject-matter jurisdiction for 1010 Vienna has exclusive jurisdiction.

11.4 There are no verbal side agreements. Declarations may be made by email, provided you have given us an email address.

11.5 Should any provision of these T&Cs be invalid, the remaining provisions shall remain unaffected.
